Germany’s gambling regulator, the Gemeinsame Glücksspielbehörde der Länder (GGL), has launched an investigation into the advertising practices of ADI Predictstreet, according to a report by German newspaper RND. The inquiry focuses on ADI’s advertising during the recent FIFA World Cup games, showcasing its branding on pitch-side billboards. The concern arises because ADI Predictstreet lacks a local gambling license in Germany, raising questions about the legality of its activities in the jurisdiction.

World Cup Exposure Raises Concerns

ADI Predictstreet, a prediction market operator backed by Abu Dhabi, had its branding prominently displayed during World Cup broadcasts. Notably, it was visible during the German team’s opening match, which was aired on the children’s channel KiKa. But this exposure has come under scrutiny as it potentially breaches Germany’s gambling advertising regulations. ADI had secured a betting intermediary license in Gibraltar in April, enabling it to offer its services through this licensing hub. However, without a German license, its operations in the region are deemed questionable. The GGL is now assessing whether ADI’s activities constitute illegal gambling under German laws.

Regulatory Action and Responses

Should the investigation confirm any violations, ADI Predictstreet might face regulatory actions, such as cease-and-desist orders. This could extend to associated entities, including payment processors and web hosting services. ADI Predictstreet, however, denies any intention of targeting the German market. An ADI spokesperson clarified that the company’s visibility in Germany resulted from global sponsorship agreements and media rights, not deliberate marketing efforts aimed at German consumers. Thomas Hagedorn from the German public broadcaster ZDF also noted their lack of control over the advertising content, as It’s managed by the host broadcaster and complies with Germany’s Media State Treaty.

Challenges for Prediction Markets in Europe

The investigation into ADI Predictstreet is part of a larger regulatory challenge facing prediction markets in Europe. This week, nine gambling regulators across the continent have launched a collective crackdown on these markets, which remain largely unregulated in Europe, save for Gibraltar. The debate around whether prediction markets should be categorized as gambling or financial instruments is ongoing. In Europe, these markets are generally treated as gambling products, leading to widespread bans, including recent actions against operators like Polymarket and Kalshi.

The outcome of the GGL’s investigation is yet to be determined. If ADI Predictstreet is found to have violated German gambling laws, it could set a major precedent for prediction market operators eyeing the European market.
